The reform of Ayelet Shaked modifying the civil procedure regulations, תשע"ט-2018

Justice Minister Ayelet Shaked announced the completion of the “New Civil Codex,” which constitutes a substantial and wide-ranging reform of the Civil Procedure Regulations.

The entry into force of the new Civil Procedure Regulations was postponed to February 1, 2020.

As part of the reform, a single central method was established for initiating legal proceedings, including the filing of claims. Accordingly, unnecessary procedures such as summary proceedings and petitions were abolished. The number of regulations was significantly reduced, chapters and sections were arranged chronologically to match the order of judicial proceedings, and a uniform framework of deadlines was set.

Main points of the reform:

     The number of regulations was reduced from 532 to only 180.

     Fundamental principles were established to serve as a “guiding light” for judges in civil proceedings and as a primary interpretive tool for various procedural issues.

     A legal clerk will be appointed to prevent the acceptance of documents that do not comply with the new regulations or court orders.

     Binding timeframes and quantitative measures were added, enforceable by the legal clerk.

     Reduction of alternatives for determining venue (jurisdiction).

     Clear structuring of pleadings, including page limits, and a single method for initiating all proceedings.

     Preliminary hearings without a judge.

     Significant expansion of the “Information, Evaluation, and Coordination” program (Mahut).

     Rules for awarding costs in applications.
